We are “Your Art” and the “Customer” is any person or company placing an order with us to
carry out work. “Originals” are the photographs, digital images, artwork and such like sent to
Your Art for reproduction on canvas or paper. The “Goods” are the finished reproductions on
paper or canvas supplied to the Customer.
CUSTOMERS ORDERS
Where the Customer places an order with “Your Art” the Customer accepts these terms and
conditions without variation. Any variation shall be mutually agreed in writing.
Your Art require sufficient information to carry out the work ordered before an order can be
processed. If all relevant information has not been provided, standard prices or the quotation
may be invalid and your order may be delayed or additional charges involved.
Your Art will not accept any order to reproduce any image that in our opinion is illegal, immoral
or libellous and the Customer shall indemnify Your Art in respect of cost arising from any legal
action for libel or infringement of trademarks etc.
Where digital files are supplied to Your Art as Originals, images are assumed to be “print-ready”
except for minor work such as size increase, cropping and straightening etc. Any colour changes
etc are not included unless specifically provided for by Your Art.
Where additional work is required that is not included within our standard prices, then we will
apply an additional charge at the rate of £12 per 15minutes of work.
We will advise you of any additional charges before we incur these.
All print and trim sizes are nominal and we accept no responsibility for small variations in size.
All work will carry the Your Art logo and address details on the reverse side.
QUALITY
We always use colour management but some colour variance may occur.
Where technically possible, we will try to meet Customers requests for colour specific matching
requirements.
Unless the Customer has provided specific colour samples, we can only do our best to match the
colours you require.
Your Art decision shall be final in matters of interpretation of colours
ORIGINALS
We will take of your Originals and treat them carefully.
If loss or damage to an Original occurs whilst under our care, our liability for loss will be limited
to our standard price for the order placed or to our quotation value where we have supplied a
quotation.
Customers’ Originals for example; photographs, artworks, CD’s and DVD’s, digital camera storage
media etc will be returned to the Customer with the completed work.
PRICES
Standard prices are shown on our web site and our printed literature. Your Art may alter prices
without notice.
PAYMENT
Payment shall be made by cheque with the Customers order prior to any work being undertaken.
• Account facilities are available for Customers providing regular on-going business.
• Where payment is made on an account approved by Your Art, payment shall me made within thirty
days of the invoice date.
• Your Art reserves the right to charge interest on unpaid invoices and the interest shall accrue and
shall be calculated in accordance with the Late Payment of Commercial Debts Act 1998 and all
subsequent amendments.
• Vat will apply at the current rate to all prices charged.
OWNERSHIP OF GOODS
For Goods that have been paid for in advance, ownership of the Goods (title) shall change from
Your Art to that of the Customer on delivery. For Goods paid for on account, ownership of Goods
shall change from Your Art to the Customer on payment of the account.
CANCELLATION
Any order cancelled will incur a charge of 35%. If printing has commenced then full payment
shall be made.
DELIVERY
We really try to maintain delivery dates but we accept no responsibility for any costs or losses
incurred by any Customer due to delays in delivery by Your Art for whatever reason.
We cannot guarantee carriage times beyond our control.
CARRIAGE AND PACKAGING
Your Art will deliver by the most cost-effective means available usually courier or mail.
COPYRIGHT
The Customer warrant he/she/they own the copyright or warrants that they have obtained all
necessary copyright permissions to reproduce the Original and the Customer indemnifies Your Art
from any cost arising from any legal action involving copyright infringement.
The Customer also warrants the Originals are free from any third party claims for breach of
copyright or licence.
STORAGE OF IMAGES
Digital images made by Your Art from the Customers Originals shall remain the exclusive property
of Your Art.
Your Art shall store digital images for 28 days after completion of work after which time all digital
images shall be removed from our systems. Images are available on CD at additional cost but will
be no longer available after 28 days following completion of work.
